Kimberly Uptain

General Counsel

Being an attorney is what she does, not who she is. She measures her life by a simple standard: at the end of the day, is someone better off for having known her? She strives to ensure that her legal representation has served clients, colleagues, judges, and juries well. One of her greatest professional honors was representing veterans for more than 18 years as a National Certified Veterans Disability Attorney. After twenty-three years of litigation practice, she embraced a new challenge as General Counsel at Guardian Litigation Group, where she works alongside individuals dedicated to making a meaningful difference in people’s lives every day.

In October 2025, she served as lead defense attorney in a $200 million trade secret lawsuit. From 2020 to 2025, she consulted with numerous firms across the United States and Europe to implement attorney structuring initiatives and develop overall legal and business strategies. In 2025, she assisted in the litigation of twenty-seven ERISA class actions in various United States District Courts nationwide. Between 2021 and 2023, she litigated more than fifty FDCPA and FCRA class actions. In February 2014, she solo tried a class action against the State of Alabama and secured a $5 million jury verdict on behalf of two classes comprising more than nine thousand class members.

In 2011 and 2012, her firm assisted in the CompuCredit class action heard by the United States Supreme Court. In 2007 and 2009, her firm assisted in a class action against the Jefferson County and Shelby County Tax Collectors, resulting in the recovery of more than $30 million for the plaintiff classes. From 2006 to 2016, she worked on more than one hundred mass tort cases, including matters involving vaginal mesh sling, Actos, and asbestos.

Prior to earning her law degree, she worked as a paralegal from 1987 to 2000 on more than fifty class actions and multidistrict litigations (MDLs). From 2000 to 2001, she clerked at Whatley Drake, LLC, where she worked on the Firestone and Ford rollover class actions. In 2004, she established her own law firm.

Outside of her professional work, she enjoys golfing, yachting, and competition pickleball.
